Terms of service

These terms are the agreement between you and sparktoprompt when you use the service. Please read the licence section — it explains how you may use the specifications you export.
1. Agreement to these terms
By creating an account or using sparktoprompt, you agree to these terms. If you do not agree, please do not use the service. sparktoprompt is operated by Marek Matan, a sole proprietorship (jednoosobowa działalność gospodarcza) registered in Poland. NIP: 5223268452.
2. The service
sparktoprompt is a tool for designing user journeys as structured diagrams and exporting them as machine-readable specifications. The service is under active development and offered on an early-access basis; features may change.
3. Your account
You are responsible for keeping your login credentials secure and for the activity under your account. Provide accurate information when you sign up, and let us know promptly if you believe your account has been used without your permission.
4. Acceptable use
You agree not to:
- use the service to break the law or infringe anyone else's rights;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the service or other users' data;
- resell or redistribute the service itself as your own product.
5. Your content and the export licence
You own what you create. The journeys you build and the content you enter remain yours. You grant us only the limited permission needed to store and display that content back to you so we can run the service.
Exported specifications. When you export a journey, sparktoprompt generates a specification document (Markdown and Mermaid). How you may use that output depends on your plan:
- Free — licensed for personal, evaluation, and non-commercial use only. Free-tier exports include a machine-readable licence header stating this restriction. Commercial or corporate use requires a paid plan.
- Pro — grants an individual commercial licence: you, as one individual, may use exported specifications in your commercial and client work. Pro exports carry a machine-readable licence header recording this grant.
- Business — grants a company commercial licence: the organisation on the plan may use exported specifications in its commercial work. Business exports carry a machine-readable licence header recording this grant.

6. Our intellectual property
The sparktoprompt software, brand, and website are ours and are protected by law. These terms do not transfer any ownership of the service to you — only the licence to use it described here.
7. Plans, payment, and cancellation
Paid plans are billed in euros through our payment provider, Lemon Squeezy, which acts as the Merchant of Record and handles payment and any applicable VAT. Prices and billing periods are shown on the pricing page. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. 8. Availability and changes
We work to keep sparktoprompt available and reliable, but we do not guarantee uninterrupted service, and we may add, change, or remove features. During early access some features may be labelled beta and may behave unexpectedly.
9. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. You are responsible for reviewing exported specifications before relying on them. Nothing in these terms excludes rights you have as a consumer that cannot be excluded under applicable law.
10. Limitation of liability
To the fullest extent permitted by law, sparktoprompt will not be liable for indirect or consequential loss, or for loss of data, profits, or business. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose. This does not limit liability that cannot be limited under applicable law, including your mandatory consumer rights.
11. Termination
You may stop using the service and delete your account at any time from Settings. We may suspend or terminate an account that breaches these terms. On termination, the licence to use the service ends; the export licences for specifications you generated while your plan was active are not retroactively revoked.
12. Governing law
These terms are governed by the law of Poland, without affecting the mandatory consumer-protection rights of the country in which you live.
13. Changes to these terms
We may update these terms as the product develops. When we make a material change we will update the “Last updated” date above and, where appropriate, notify you. Continuing to use the service after a change means you accept the updated terms.
